We believe that Tom Robinson’s constitutional rights were violated. In the sixth amendment it states “in all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed”. When he was tried for his alleged actions of raping Mayella Ewell he was tried before a jury of all white men who were neither impartial or from the district of Mr.Robinson. "There's something in our world that makes men lose their heads—they couldn't be fair if they tried. In our courts, when it's a white man's word against a black man's, the white man always wins. They're ugly, but those are the facts of life.” This clearly states that no matter what the evidence says the jury would have found Tom guilty.How can this jury impartial if they have decided before they even showed up to the court house.How can any black person be given an impartial jury if black people can’t even be part of a jury. “Tom was a dead man the second Mayella opened her mouth and screamed”. How can the rights of the black people of america be upheld when even in our courts they are prosecuted for the color of their skin not for the crimes they have committed. In our constitution in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. It says for the united states of america. I’m pretty sure tom Robinson is a member of the United states so why wasn’t the rights to the people in the preamble upheld. No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger. In this case according to the constitution Tom Robinson shouldn’t have been convicted because only a grand jury can convict someone of a capital or infamous crime.for these reasons we believe that Tom should not have been convicted.
